By accessing or using TrustMetric ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

Eligibility

You must be at least 18 years old and have the legal authority to enter into these terms on behalf of yourself or your business.

Changes

We may update these terms from time to time. We'll notify you via email for material changes. Continued use after changes constitutes acceptance.

The Service

What TrustMetric Provides

TrustMetric is a review management platform that provides AI-generated review responses, SMS review request delivery, review analytics, and connected platform integrations.

Availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. Planned maintenance will be communicated in advance. We are not liable for downtime outside our reasonable control.

Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. We'll provide reasonable notice for significant changes.

Your Account

Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

Accurate Information

You agree to provide accurate, current, and complete information when creating your account and to keep it updated.

One Account Per Business

Each business location requires its own subscription. Creating multiple accounts to circumvent plan limits is prohibited.

Account Termination

You may delete your account at any time from dashboard settings. We may terminate or suspend accounts that violate these terms.

Subscriptions & Billing

Free Trial

New accounts receive a 14-day free trial with full Professional plan access. No credit card is required to start. After the trial, you must subscribe to continue using the Service.

Billing Cycle

Subscriptions are billed monthly on the date you subscribe. All prices are in USD.

Cancellation

You may cancel at any time. Cancellation takes effect at the end of your current billing period. No refunds are issued for partial months, except as described in our 30-day guarantee.

30-Day Guarantee

If you are unsatisfied within the first 30 days of your paid subscription, contact us for a full refund. After 30 days, no refunds are issued.

Price Changes

We will provide at least 30 days notice before changing subscription prices. Price changes take effect on your next renewal date.

Acceptable Use

Permitted Use

TrustMetric is provided for legitimate business reputation management. You agree to use the Service only for lawful purposes and in accordance with these terms.

Prohibited Actions

You may not: use the Service to send spam or unsolicited messages; attempt to manipulate review platforms in violation of their terms; reverse engineer or copy any part of the Service; use automated tools to scrape or extract data; or impersonate another business or individual.

Review Platform Compliance

You are responsible for ensuring your use of TrustMetric complies with the terms of service of Google, Yelp, and other review platforms. We do not condone fake reviews or review manipulation.

SMS Compliance

You are responsible for obtaining proper consent before sending SMS messages through TrustMetric. You must comply with TCPA and all applicable telecommunications regulations.

AI-Generated Content

Your Responsibility

AI-generated review responses are suggestions. You are responsible for reviewing and approving content before publishing. We are not liable for the content of AI responses you choose to publish.

Accuracy

AI responses are generated based on review content and your settings. They may occasionally be inaccurate or inappropriate. Always review before publishing.

Ownership

You own the AI-generated content that TrustMetric creates for your account. We do not claim any rights over your review responses.

Intellectual Property

TrustMetric IP

The TrustMetric platform, brand, logo, and underlying technology are owned by TrustMetric Inc. These terms do not grant you any rights to our intellectual property.

Your Data

You retain ownership of your business data, reviews, and content. You grant us a limited license to process this data to provide the Service.

Feedback

If you provide feedback or suggestions, we may use them to improve the Service without obligation or compensation to you.

Limitation of Liability

Disclaimer

The Service is provided "as is" without warranties of any kind. We do not warrant that the Service will be error-free, uninterrupted, or meet your specific requirements.

Liability Cap

To the maximum extent permitted by law, TrustMetric's total liability to you for any claims arising from these terms or use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Exclusions

We are not liable for: loss of profits or revenue; loss of data; indirect or consequential damages; or damages resulting from third-party services including Google, Twilio, or payment processors.

Governing Law

Jurisdiction

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.

Disputes

Any disputes arising from these terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes will be handled through binding arbitration.
